The legal dispute over the planned takeover of Warner Bros. Discovery by Paramount Skydance continues to escalate. Whilst California and Paramount are negotiating a possible out-of-court settlement, Iowa and Montana have now taken the matter to the US Supreme Court. This takes the conflict to a new legal and political level.<\/p>

In July, California\u2019s Attorney General Rob Bonta, together with eleven other states, filed a lawsuit against the takeover, which is worth around 110 billion dollars. The plaintiffs argue that the merger would significantly restrict competition in areas such as cinema distribution and the licensing of cable channels, amongst other things.<\/p>

Recently, however, hopes had begun to emerge for an out-of-court settlement. Representatives from Paramount and the California Attorney General\u2019s Office held talks on possible compromises. Among other things, structural measures and the possible spin-off of individual cable channels were under discussion. However, Bonta cancelled a meeting scheduled for 24 August at short notice. He accused Paramount of leaking confidential details of the talks to the outside world and misrepresenting them. Paramount rejected the accusation and stated that it remained willing to negotiate in good faith.<\/p>

Nor has a new date for talks been set at present. At the same time, Bonta emphasised that his agency was, in principle, prepared to engage in further negotiations, provided that Paramount, in his view, proceeded in a serious and confidential manner.<\/p>

Now there is further movement from two Republican-governed states. Iowa and Montana have asked the US Supreme Court to intervene in the dispute and to halt the antitrust case brought by California and eleven other states against the takeover.<\/strong> The two Attorneys General, Brenna Bird and Austin Knudsen, are thus taking a stand against the coalition of claimants and describing their approach as politicised competition law enforcement.<\/p>

Bird had already announced this move. The application has now actually been submitted. Iowa and Montana argue that the ongoing block on the merger is causing economic damage and, in particular, is creating difficulties for both companies in terms of production planning and investment.<\/p>

However, it remains to be seen whether the Supreme Court will even admit the application and hear the case. The course of action now taken therefore represents, for the time being, primarily a further legal initiative in what is already a complex case.<\/p>

The outcome of the proceedings is of considerable significance to the film industry. Paramount and Warner Bros. are among the major US film studios and key players in cinema distribution, film production, television and streaming. The Californian claimants argue that the merger will, amongst other things, lead to a reduction in competition in film distribution and potential disadvantages for cinemas and content providers.<\/p>

This means the takeover remains up in the air for the time being: There is no sign of an agreement between Paramount and the claimants; at the same time, the legal dispute is being taken to a new level by the move from Iowa and Montana.<\/strong> The negotiating table, which was originally envisaged as a possible route to a swift solution, has thus, for the time being, been supplemented by an additional legal arena.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t
