The final debate on the MedienInvestVG in the Bundestag\u2019s Committee on Culture and Media has been withdrawn from the agenda at short notice. This move comes at a time when the debate over the planned investment obligation for streaming services is becoming increasingly heated. Whilst international platform providers are warning of the economic consequences of the regulation, German production associations are pressing for binding requirements and the retention of key provisions in the draft bill.<\/p>

On 3 November, the Motion Picture Association (MPA) published a consumer survey carried out by FGS Global on behalf of the association. Of the 1,000 people surveyed in Germany between 13 and 17 October, 40 per cent were against the proposed investment requirement, whilst 20 per cent were in favour. 70 per cent feared higher prices for streaming subscriptions. However, 64 per cent of those surveyed were not aware of the proposed legislation prior to the survey. The MPA is using the results to underpin its criticism of the planned regulations.<\/p>

Amazon Germany is also stepping up the pressure on politicians. In a post on \u201eAbout Amazon\u201c on 3 November, Country Manager Rocco Br\u00e4uniger spoke out against the current draft. The company is particularly critical of the proposed reversion of rights to producers, the fixed investment quotas and the additional bureaucratic requirements. Amazon argues that the regulations could restrict the economic flexibility of platforms and make it more difficult to invest in German productions. Br\u00e4uniger is therefore calling for the draft to be scrapped or fundamentally revised.<\/p>

The production alliance \u2013 PROG Producers of Germany, AG DOK and the German Film Academy \u2013 had already spoken out in favour of a binding investment commitment at the committee hearing on 14 October. At the heart of their demands are the retention of the proposed investment quotas of eight and twelve per cent respectively, and effective regulations on the reversion of rights. From the associations\u2019 point of view, these requirements are crucial to ensure that independent production companies not only benefit from additional commissions but can also build up commercially exploitable rights. In their view, any watering down of these provisions would significantly limit the law\u2019s effectiveness.<\/p>

With the removal of this item from the agenda, it remains unclear when the committee will resume its final deliberations.
