The Federal Cabinet has passed an implementing law to implement the European AI Regulation. This fulfils the requirements of the Regulation of the European Commission, which came into force in August 2024. European Union embedded in national law and concretised in organisational terms.

Among other things, the law specifies which national authorities are responsible for applying and monitoring the new regulations. The aim is to ensure compliance with European regulations when using artificial intelligence in Germany.

According to the Federal Government the implementing act also contains clarifications on media supervision. According to this, the federal division of responsibilities is maintained: the federal states remain responsible for press and broadcasting. According to the government, this clarification was given special consideration during the legislative process.

Minister of State for Culture Wolfram Weimer welcomed the decision and emphasised the importance of clear responsibilities in the area of media regulation. In Germany, issues relating to AI regulation also affect the existing, non-governmental media organisation. He also emphasised the need for binding rules, clear responsibilities and regular risk assessments when using AI systems.

The implementing law is intended to create a further building block for a harmonised European regulatory framework. In principle, providers and operators of AI systems must bear responsibility for their use.
